1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of resumebuilder.so, including any content, functionality, and services offered on or through resumebuilder.so (the "Service"), operated by SoSo Resume EOOD ("we," "us," or "our"), a company registered in Bulgaria with its registered office at Ul. Prof. Velizar Velkov 4A, 1618, Sofia, Bulgaria.

Please read these Terms carefully before you start using the Service. By using the Service, registering an account, or clicking to accept or agree to the Terms when this option is made available to you, you accept and agree to be bound and comply with these Terms and our Privacy Policy, found here, incorporated herein by reference.

If you do not agree to these Terms or the Privacy Policy, you must not access or use the Service.

2. Eligibility

To use the Service, you must be at least 16 years of age. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

3. Account Registration

3.1 Account Creation

To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You agree to notify us immediately of any unauthorized access to or use of your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

3.3 Account Termination

We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof) at our discretion, with or without notice to you, if we believe that you have violated these Terms or that your conduct or content would tend to damage our reputation and goodwill.

4. Subscription and Payments

4.1 Subscription Options

We offer various subscription plans, including free and premium options. Features available within each plan are detailed on our pricing page.

4.2 Payments and Billing

When you purchase a premium subscription, you agree to pay the fees indicated for your selected plan. All fees are in the currency specified on the pricing page and do not include taxes, which may be added to the final price.

Payment will be charged to your chosen payment method at confirmation of purchase and at the beginning of each subscription period. By providing your payment information, you authorize us or our third-party payment processors to charge the applicable fees to that payment method.

4.3 Free Trials

We may offer free trials of our premium services. After the trial period ends, your account will automatically convert to a paid subscription unless you cancel before the trial period expires.

4.4 Subscription Changes and Cancellations

You may upgrade, downgrade, or cancel your subscription at any time through your account settings or by contacting support@resumebuilder.so.

If you cancel a paid subscription, you may continue to use the premium features until the end of your current billing period, but you will not receive a refund for the current billing period.

4.5 Price Changes

We reserve the right to adjust pricing for our Service or any components thereof in any manner and at any time as we may determine in our sole discretion. Any price changes will become effective at the end of the then-current billing cycle.

4.6 Refunds

Refunds are provided at our discretion and in accordance with applicable laws. To request a refund, please contact support@resumebuilder.so.

5. Intellectual Property Rights

5.1 Our Intellectual Property

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by SoSo Resume EOOD, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

5.2 License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal or internal business purposes.

5.3 User Content

When you create resumes, cover letters, or other content using our Service ("User Content"), you retain ownership of your User Content. By creating or uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in connection with providing and improving the Service.

You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not violate the rights of any third party
  • Your User Content complies with these Terms and applicable laws

6. Prohibited Uses

You agree not to use the Service:

  • In any way that violates any applicable law or regulation
  • To transmit or upload any viruses, malware, or other malicious code
  • To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
  • To engage in any activity that interferes with or disrupts the Service
  • To harvest or collect email addresses or other contact information of other users from the Service by electronic or other means
  • To automate or programmatically interact with the Service without our explicit written permission
  • To attempt to circumvent any security measures or access unauthorized areas of the Service
  • To create resumes, cover letters, or other documents containing false information or misrepresentations
  • To infringe upon or violate the intellectual property rights or other rights of any person or entity

7. User Contributions and Feedback

By providing suggestions, comments, or other feedback ("Feedback") about the Service, you grant us a non-exclusive, worldwide, perpetual, irrevocable, transferable, royalty-free license to use and incorporate such Feedback into the Service without any obligation to compensate you.

8. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

9. Disclaimers

9.1 "As Is" and "As Available"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Guarantees

We do not guarantee that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results that may be obtained from the use of the Service will be accurate or reliable
  • The quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations
  • Any errors in the Service will be corrected

9.3 Employment Outcomes

We do not guarantee any employment outcomes, job interviews, or career advancements as a result of using our Service. The effectiveness of resumes and other documents created using our Service depends on many factors beyond our control.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
  • ANY CONTENT OBTAINED FROM THE SERVICE; AND
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED EUROS (€100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS.

THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN YOU AND US.

11. Indemnification

You agree to defend, indemnify, and hold harmless SoSo Resume EOOD and its officers, directors, employees, and agents, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration under the Rules of the Bulgarian Chamber of Commerce and Industry, which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat, or legal place, of arbitration shall be Sofia, Bulgaria. The language to be used in the arbitral proceedings shall be English.

12.3 EU Consumers

If you are a consumer and habitually reside in a Member State of the European Union, you additionally enjoy the protection of the mandatory provisions of the law of your country of residence. Both you and we agree to submit to the non-exclusive jurisdiction of the courts of Sofia, Bulgaria, which means that you may bring a claim to enforce your consumer protection rights in connection with these Terms in Bulgaria or in the EU country in which you live.

12.4 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution, which can be accessed at http://ec.europa.eu/consumers/odr/. If you are a consumer resident in the European Union, you may use this platform to resolve disputes related to online purchases.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including, without limitation, if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

15. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and of no effect. We may assign or transfer these Terms, at our sole discretion, without restriction.

16. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published by us on the Service, shall constitute the entire agreement between you and us concerning the Service.

17. Severability

If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of SoSo Resume EOOD.
